Additional changes to FLSA struck down in court, no longer being implemented

Earlier this year, the U.S. Department of Labor announced changes to the Fair Labor Standards Act, increasing the salary threshold for exempt employees (those not eligible for overtime).

West Virginia University took steps to comply with the first round of changes, which became effective July 1, 2024.

A second change was expected to take effect on Jan. 1, 2025, which would have further increased the minimum salary threshold. WVU was again preparing to take steps to comply with the updated law. 

However, a lawsuit was filed in federal court challenging the Jan. 1 rule change. 

On Friday (Nov. 15), a federal judge in the Eastern District Court of Texas struck down the additional changes to the FLSA rule. As such, the second round of changes will no longer be implemented.

The first round of changes to the FLSA made earlier this year and effective July 1, 2024, remain in effect.
