West Virginia University Finance and Administration Rule 5.9 – Procurement and Purchasing has been posted online for public comment.
The West Virginia University Board of Governors has issued a Notice of Proposed Rulemaking, including changing the terminology from “policy” to “rule” to potentially:
Amend and approve BOG Policy 42 – Procurement and Purchasing (proposed to be amended as Finance and Administration Rule 5.9 – Procurement and Purchasing).
The proposed change is to amend and approve a current BOG Policy in order to implement a new BOG Rule in accordance with W.Va. House Bill 2815 (2017). To that end, the term “Policy” will be replaced with “Rule” and this Policy will be reformatted to the new design for BOG Rules, renumbered, and standard terms are used, when applicable. Moreover, all BOG Rules will be updated to supersede and repeal W.Va. Higher Education Policy Commission Rules, where applicable.

The revisions will be posted for public comment for 30 days beginning February 11, 2019, and ending on March 13, 2019. All public comments received will be posted on the University’s policy website. The rule may be changed, subject to comments received. The comments, or summary thereof, and final proposed rule will be posted for 10 days prior to the Board taking final action.
