WVU BOG Rule 3.4 out for public comment

The WVU Board of Governors has issued a Notice of Proposed Rulemaking to amend WVU BOG Talent and Culture Rule 3.4 – Drug and Alcohol Testing for FTA and FMCSA Covered Positions.

The proposed amendments will better reflect the University’s current process with drug and alcohol testing on campus and clarify the categories of positions that the Rule applies to. 

Key changes include adding a new section to give express authority to the President or designee to create a drug testing policy for positions that do not fall within the scope of the Rule and more clearly defining which University positions do not fall within the scope of the Rule, as well as updating contact information for the University office responsible for administering drug and alcohol tests under the Rule.

The Rule and associated documentation are open for public comment starting today (Nov. 10) through 11:59 p.m. Dec. 11.

All public comments received, or a summary thereof, will be posted on the University’s policy website for 10 days prior to the BOG taking final action. The Rule may be changed, subject to comments received.
